Terms of Service
HOOD CANAL COMMUNICATIONS MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, AND EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF SERVICES OR GOODS HOOD CANAL COMMUNICATIONS PROVIDES FOR THE ACCOUNT HOLDER. Hood Canal Communications takes no responsibility for any damages suffered by the Account Holder and/or its officers, directors, employees and agents, including, but not limited to, loss of data, non-recoverable data, hardware or software issues, viruses or malware, security breaches, loss of time or productivity, non-deliveries, misdeliveries, or service interruptions caused by the negligence or omission of Hood Canal Communications and/or its officers, directors, employees and agents or the errors, actions and/or omissions of Account Holders and/or its officers, directors, employees and agents.
LIMITATIONS AND INDEMNIFICATION
The Account Holder agrees to indemnify and hold Hood Canal Communications, its officers, directors, employees and agents harmless from any claims by third parties, including, but limited to claims in contract, tort, specific performance, breach of warranty and attorney’s fees, arising from or related in any way to the services or products provided by Hood Canal Communications. In no event will Hood Canal Communications and/or its officers, directors, employees and agents be liable to Account Holder and/or its officers, directors, employees and agents for indirect, special, incidental, cover, punitive or consequential damages arising out of services performed or products provided by Hood Canal Communications for the Account Holder, even if advised of the possibility of such damages. In addition, Hood Canal Communications and/or its officers, directors, employees and agents are not responsible for any direct or indirect costs arising out of services or products Hood Canal Communications has provided for the Account Holder under any theory of liability, including, but not limited to, costs incurred, loss of profits or revenue, loss of clients, loss of use of computer programs or computer hardware, loss or theft of data, the costs of recovering programs or data, claims by third parties or similar costs. In no event shall the liability of Hood Canal Communications and/or its officers, directors, employees and agents exceed the amount paid by Account Holder for the services and products provided by Hood Canal Communications.
Hood Canal Communications accepts various methods of payment including some credit and debit cards. If a customer opts to make payment over the phone via credit or debit card, a processing fee of $2.99 per request per account will apply. Payments made online or in person will not incur this processing fee. Any payment received more than fifteen (15) days after the date of invoice shall be considered late and subject to a standard late fee of $8.95. Hood Canal Communications reserves the right to disconnect unpaid accounts at any time. A customer may initiate a disconnect of any service by contacting the customer service department at (360) 898-2481. Most services are monthly and may be prorated. If all services on an account are disconnected, the customer may be eligible for a refund for prepaid prorated services. Refunds will be generated as soon as the next monthly bill cycle following the date of disconnect.
